Terms of Service

1. Acceptance of Terms

By accessing or using the ISA-95 Dashboard Factory platform ("Service"), operated by Syncoe Enterprise ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

ISA-95 Dashboard Factory provides pre-built manufacturing dashboards, real-time data connectors (OPC-UA, MQTT), compliance reporting, and analytics tools for factory floor operations. The Service is offered in four tiers: Free, Standard, Premium, and Enterprise.

3. Subscription Plans and Pricing

  • Free: RM 0/month, limited features
  • Standard: RM 199/month, 14-day free trial
  • Premium: RM 499/month, 14-day free trial
  • Enterprise: RM 2,999/month, custom onboarding

All prices are in Malaysian Ringgit (MYR) and exclude applicable taxes. We reserve the right to change pricing with 30 days written notice.

4. Free Trial

Standard and Premium plans include a 14-day free trial. During the trial period, you will not be charged. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5. Payment Terms

  • Payments are processed by Stripe (PCI DSS compliant)
  • Billing occurs monthly on the anniversary of your subscription start date
  • Failed payments will be retried for 7 days before subscription suspension
  • All fees are non-refundable except as required by applicable law

6. Cancellation and Refund

  • You may cancel your subscription at any time via your account settings or by contacting support
  • Cancellation takes effect at the end of the current billing period
  • You will retain access until the end of the paid period
  • Pro-rata refunds are available within 7 days of a billing charge upon request
  • Trial cancellations incur no charges

7. Service Level Agreement (Enterprise)

Enterprise tier customers receive:

  • 99.5% uptime SLA (excluding scheduled maintenance)
  • 4-hour response time for critical issues
  • Dedicated support contact
  • Scheduled maintenance windows with 48-hour advance notice

8. Intellectual Property

  • All dashboard templates, designs, and software are owned by Syncoe Enterprise
  • You receive a non-exclusive, non-transferable license to use the Service during your subscription
  • You retain ownership of all data you input into the Service
  • Enterprise customers may request custom dashboard ownership terms

9. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Service
  • Share your account credentials with unauthorized users
  • Use the Service for unlawful purposes
  • Attempt to compromise the security or integrity of the platform
  • Resell or redistribute the Service without written permission

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, Syncoe Enterprise shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service for breach of these Terms, with notice. Upon termination, your right to use the Service ceases immediately. We will provide a reasonable opportunity to export your data.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
